Andrew Colgan

Andrew has experience in a range of areas of civil litigation, with an emphasis on maritime and professional indemnity law. As well as frequent involvement in mediation and other forms of alternative dispute resolution, Andrew has experience preparing for and conducting defended hearings and trials in both the District and High Courts.

Andrew completed degrees in Commerce (Economics) and Law before undertaking an LLM looking at the international legal framework for preferential trade agreements, for which he received First Class Honors. He was admitted as a barrister and solicitor of the High Court of New Zealand in 2009 and joined McElroys in 2010. Andrew is a member of the Maritime Law Association of Australia and New Zealand (MLAANZ) and Law & Economics Association of New Zealand (LEANZ)

  • Marine Insurance – cargo, hull & machinery, statutory liability, freight forwarders, boat builders and repairers
  • Cargo and transport – carriage of goods (domestic and international), storage and bailment, carriers’ liability, subrogated cargo recoveries
  • Professional Indemnity – lawyers, valuers, accountants
  • General and liability – motor, material damage, marine industry liability
  • Regulatory and Health & Safety – investigations and prosecutions by Worksafe, Maritime New Zealand and Commerce Commission

  • Knowledge of and experience in civil procedure.
  • Negotiation, mediation and alternative dispute resolution.
  • Guiding clients and insured parties through the litigation process.
  • Good working relationship with international shipping lines, and access to leading marine industry experts.

Recent trial involvement/outcomes:

  • Numerous negotiated settlements of cargo claims against international shipping lines.
  • Successful claim against bailee for loss of motor vehicle.
  • Supporting maritime operators through investigations by Maritime New Zealand following incidents involving injuries and fatalities.
  • Successful application for discharge against conviction under in maritime prosecution.
  • Appeared as junior counsel in AWDA v Mobil (2013).
